Tactical Despatch - Driver Terms and Conditions / Service Level Agreement (SLA)
1. Introduction
1.1 These Terms and Conditions constitute a legally binding agreement ("Agreement") between Tactical Despatch ("Company") and the self-employed driver ("Driver").
1.2 By accepting jobs through the Tactical Despatch app ("Zoom Courier"), the Driver agrees to comply with these Terms and Conditions.
2. Engagement
2.1 The Driver is engaged as a self-employed contractor. Nothing in this Agreement shall render the Driver an employee, worker, agent, or partner of the Company.
2.2 The Driver is responsible for all taxes, National Insurance contributions, and any other liabilities, deductions, or withholdings relating to payments made to the Driver.
3. Services
3.1 The Driver agrees to provide courier services ("Services") by accepting and completing delivery jobs through the App.
3.2 The Driver shall ensure that all deliveries are completed within the agreed timeframes and to the specified locations.
4. Acceptance of Jobs
4.1 Jobs will be posted on the App and the Driver can choose to accept any job at their discretion.
4.2 Once a job is accepted, the Driver is contractually obliged to complete the delivery in accordance with the job details and these Terms and Conditions.
4.3 We reserve the right to remove any scheduled or on going jobs depending on service requirements.
5. Driver Obligations
5.1 The Driver shall:
a) Provide the Services with reasonable care and skill.
b) Maintain a valid driving license, Vehicle Insurance, Goods in Transit Insurance, and any other required certifications.
c) Ensure the vehicle used for deliveries is roadworthy, maintained, and complies with all legal requirements.
d) Adhere to all applicable laws and regulations while performing the Services.
e) Act in a professional and courteous manner at all times.
5.2 The Driver shall promptly notify the Company of any inability to complete a job.
6. Fees and Payments
6.1 The Driver will be paid per job as specified in the App.
6.2 Payments will be made weekly 3 Weeks after job completition via bank transfer to the account details provided by the Driver.
6.3 The Company reserves the right to withhold payment for any jobs not completed in accordance with this Agreement.
7. Insurance and Liability
7.1 The Driver must maintain comprehensive vehicle insurance, including coverage for the carriage of goods for hire and reward.
7.2 The Driver is liable for any loss or damage to goods in transit unless such loss or damage is due to the Company's fault.
8. Confidentiality
8.1 The Driver agrees to keep confidential any information received in the course of performing the Services, including but not limited to customer details, delivery information, and business practices.
9. Termination
9.1 Either party may terminate this Agreement at any time with immediate effect by providing written notice to the other party.
9.2 The Company may terminate this Agreement without notice if the Driver breaches any terms of this Agreement.
10. Amendments
10.1 The Company reserves the right to amend these Terms and Conditions at any time. Any amendments will be communicated to the Driver via the App.
11. Governing Law
11.1 This Agreement shall be governed by and construed in accordance with the laws of England.
12. Dispute Resolution
12.1 Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England.
Service Level Agreement (SLA)
1. Objective
1.1 This SLA outlines the expected performance standards for Drivers providing Services for Tactical Despatch.
2. Performance Standards
2.1 The Driver shall:
a) Achieve a minimum on-time delivery rate of 99%.
b) Maintain a customer satisfaction rate of at least 99%.
c) Ensure no more than 1% of deliveries result in complaints related to service quality.
3. Monitoring and Reporting
3.1 The Company will monitor the Driver's performance through customer feedback and delivery records.
3.2 Performance reports will be reviewed on a monthly basis, and the Company will provide feedback to the Driver as necessary.
4. Consequences of Non-Compliance
4.1 Failure to meet the performance standards set out in this SLA may result in:
a) Additional training or support.
b) Reduction in job assignments.
c) Termination of this Agreement.
5. Review and Amendment
5.1 This SLA will be reviewed annually and may be amended by the Company as necessary.
By accepting jobs through the Tactical Despatch app, the Driver acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions and the Service Level Agreement.
